1. General provisions

 

1.1. MB Loconinjo (hereinafter – „the Seller“) is managed by Sandra Neverovienė, company code 306013737, address Međiotojų st. 2, LT-72311 Tauragė, contact number +37064815241, e-mail info@loconinjo.lt, conducts trade in accordance with the rules of buying and selling goods of the online store www.loconinjo.lt.

1.2. These rules for the purchase and sale of goods (hereinafter – the “Rules”) are a legal document binding on the parties, which determine the rights and obligations of the Buyer and the Seller, the terms of purchase and payment for the goods, the procedure for the delivery and return of the goods, the responsibilities of the parties and others related to the purchase of goods – sale www.loconinjo.lt provisions related to the online store.

1.3. The seller reserves the right to change, amend or supplement the Rules at any time, taking into account the requirements of legal acts. The registered person will be informed about any changes, corrections or additions before purchasing the selected goods in the online store www.loconinjo.lt. Before confirming the purchase, the buyer must agree to the changed Rules again (by ticking the box with the attachment “I have read and agree to the site terms and conditions”). If the Buyer does not agree with these rules, in this case, we ask you to make an orderly purchase – sales transactions in the online store www.loconinjo.lt and not to use the services of this online store.

1.4. Online stores www.loconinjo.lt trade is carried out in the territory of the Republic of Lithuania and in other countries.

1.5. Buying www.loconinjo.lt in the online store has the right:
1.5.1. all natural persons are of legal age;
1.5.2. minors between the ages of fourteen and eighteen, only with the consent of their parents or guardians, except in cases where they independently dispose of their income;
1.5.3. legal entities;
1.5.4. authorized representatives of all the above persons.

2. Protection of personal data

2.1. Registering www.loconinjo.lt in the online store, Buyers must provide correct personal information (name, surname, e-mail address). When purchasing goods, the Buyer must provide additional correct data (full address of the payer, full address of the recipient, phone, select the payment method. 2.2. Online store www.loconinjo.lt undertakes not to disclose any information to third parties, with the exception of the partners of the online store www.loconijo.lt, who provide goods delivery or other services related to the submission or fulfillment of the Customer’s order. Any other exceptions to the disclosure of the Buyer’s personal information to third parties shall be negotiated with the Buyer in all cases. In all other cases, any personal data of the Buyer may be disclosed to third parties only in the cases provided for in the legal acts of the Republic of Lithuania.

2.3. The Customer agrees that the Seller has the right to process the Customer’s personal data in the cases and for the purposes specified in these Rules.

2.4. The seller confirms that the Customer’s personal data will be used for the Customer’s identification when ordering the goods, for the delivery of the ordered goods.

3. The moment of conclusion of the purchase-sale contract

3.1 . The contract between the Buyer and the Seller is considered concluded from the moment when the Buyer, after selecting the item(s) to be purchased and creating a shopping cart, clicks on the “Pay” link. From that moment, the Buyer is obliged to pay for the ordered goods at the prices determined at that time and to accept these goods.

3.2. The contract is considered completed when the Buyer pays for the goods and receives them.

3.3. The appendix is ​​considered an integral part of this contract, i.e. the order confirmation, which is sent to the Buyer by the specified e-mail, with the information specified in it.

3.4. All sales contracts concluded between the Buyer and the Seller are registered and stored in the online store www.loconinjo.lt database.

3.5. The contract is terminated when the order is canceled by one of the parties to the contract or when the Buyer has a reasonable demand to return all (part) of the money paid for the product, to replace the product with a product of the same suitable quality, to remove the defects of the product within a reasonable time or to compensate the costs of removing the defects, if removed himself or with the help of third parties is satisfactory.

3.6. If the contract is terminated, the money is returned to the customer within 14 working days.

3.7. When refunding the customer, the same payment method is used that the customer used to pay for the transaction.

3.8. Each time an order is placed, a new sales contract is concluded.

4. Buyer’s rights

4.1. The buyer has the right to buy the goods in the online store www.loconinjo.lt according to the procedure established by these Rules.

4.2. The buyer has the right to refuse the contract of purchase and sale of goods concluded with www.loconinjo.lt in the online store by notifying the Seller in writing (by contacting the staff of the www.loconinjo.lt online store using the means of communication specified in the “Contacts” section and filling out the Beautification form) no later than within 14 (fourteen) working days from the day of delivery of the goods, except in cases where the contract was concluded for supply of underwear and baby clothes.

4.3. 1.4 of the rules. The Buyer’s right provided for in paragraph 1 is implemented in accordance with the 2001 Decree of the Minister of Economy. August 17 by order no. 258 of the approved “Rules for the sale of goods and provision of services when contracts are concluded using means of communication”.

4.4. 1.4 of the rules. The Buyer can exercise the right provided for in paragraph 1 only if the product has not been damaged or its appearance has not fundamentally changed, nor has it been used (the original labels and markings have not been torn off).

5. Obligations of the buyer

5.1. The buyer must pay for the goods and accept them in accordance with the procedure established by these Rules.

5.2. The buyer undertakes not to transfer his login data to the user interface available in the www.loconinjo.lt online store to third parties. If the Buyer loses his login data, he must immediately inform the Seller about this in the section „Contacts“ specified means of communication. In case of violation of these rules, all related responsibility rests with the Buyer.

5.3. If the data provided in the Buyer’s registration form changes, he must update it immediately.

5.4. The buyer using www.loconinjo.lt the online store undertakes to comply with these Rules, other conditions clearly indicated in the online store and not to violate the legal acts of the Republic of Lithuania.

5.5 The buyer is responsible for submitting correct data to the online store www.loconinjo.lt

6. Seller’s rights

6.1. If the Buyer tries to harm the online store www.loconinjo.lt work stability and safety or violates its obligations, the Seller has the right to immediately and without warning limit or suspend his access to www.loconinjo.lt online store and/or cancel the Buyer’s registration. Any attempts to undermine the stability of the online store are investigated and, if necessary, referred to law enforcement authorities.

6.2. In the event of important circumstances, the Seller may terminate temporarily or completely www.loconinjo.lt online store operations without notifying the Buyer in advance.

6.3. The Seller has the right to cancel his order without notifying the Buyer in advance, if the Buyer, having chosen Rule 8.2. and 8.3. payment methods provided in points, does not pay for the goods within 2 (two) working days.

6.4. When the Buyer chooses Rule 8.2.3. the method of payment provided for in point – in cash at the time of delivery of the goods, the Seller, in the event of ambiguities regarding the information provided in the order, contacts the Buyer by the telephone number specified in the order. In this case, the term of delivery of the goods starts counting from the day of contact with the Buyer. The Seller has the right to cancel the order without prior notice to the Buyer if the Seller fails to contact the Buyer within 2 (two) working days.

7. Obligations of the seller

7.1. The seller undertakes in these Rules and www.loconinjo.lt to enable the Buyer to use the services provided by the online store www.loconinjo.lt under the conditions set in the online store.

7.2. The Seller undertakes to respect the Buyer’s privacy right to the personal information he owns, specified www.loconinjo.lt in the registration form of the online store, except for the cases established by the laws of the Republic of Lithuania, when a criminal act related to the Buyer is committed, and these data are needed by law enforcement authorities.

7.3. The Seller undertakes to deliver the goods ordered by the Buyer to the address specified by him under the conditions specified in Clause 9 of the Rules. The Buyer is responsible for the correctness of data submission.

7.4. The Seller, unable to deliver the ordered goods to the Buyer due to important circumstances, undertakes to offer an analogous or similar product as far as possible. If the buyer refuses to accept an analogous or similar product, the seller undertakes to return the money paid to the buyer within 7 (seven) working days, if prepayment was made.

7.5. The seller undertakes to provide the correct information necessary to fully pay for the ordered goods, but does not assume any responsibility for the poor quality services of the banks and the resulting losses. Also, the seller does not assume any responsibility for errors made by the Buyer when forming and executing the order (e.g. entering the wrong account number, incorrectly entered order code, etc.) and the resulting losses.

8. Product prices, payment procedure and terms

8.1. The prices of goods in the www.loconinjo.lt online store and in the formed order are indicated in euros. The prices of the goods indicated in the store are final.

8.2. The buyer pays for the goods in one of the following ways:

8.2.1. Payment using UAB OPAY Solutions (opay.lt) payment collection system.

8.2.1.1. This system is a safe way to pay for goods quickly and conveniently. Using it, you will not have to create the order yourself – the integrated system will do it for you. At the end of the order, you will be directed to opay.lt system, where you can choose the payment method acceptable to you. All you have to do is select the bank whose electronic services you use by clicking on the bank’s logo and you will be directed to your bank’s website, where, after entering your login details, you will see an account that has already been created for you, which you will need to confirm and pay. We will find out about your payment shortly after the settlement is completed. 8.3. Payment can be made by credit card.

8.4. In accordance with 8.2. and 8.3. the payment methods provided in point, the Buyer undertakes to pay immediately. In the aforementioned cases, taking into account Rule 6.3. the right of the Seller provided for in point. Payment can be made by credit card.

9. Delivery of goods

9.1. When ordering the goods, the buyer undertakes to indicate the place of delivery of the goods.

9.2. The buyer undertakes to accept the goods himself. In the event that he cannot accept the goods himself, and the goods are delivered to the specified address and based on other data provided by the Buyer, the Buyer does not have the right to make claims to the Seller regarding the delivery of the goods to the wrong entity.

9.3. The goods are delivered by the Seller or his authorized representative.

9.4. The seller undertakes to deliver the goods no later than within 2-6 working days (excluding holidays) from sending the confirmation of order execution to the buyer. These terms do not apply in cases where the necessary goods are not available in the Seller’s warehouse, and the Buyer is informed about the shortage of the goods ordered by him. At the same time, the Buyer agrees that in exceptional cases the delivery of the goods may be delayed due to unforeseen circumstances beyond the control of the Seller. In this case, the Seller undertakes to immediately contact the Buyer and coordinate the delivery of the goods.

9.5. Delivery in Lithuania by Lithuanian post, postal machine or courier can take from 1 to 10 working days.

9.6. Delivery to foreign countries by Lithuanian Post can take 10 to 15 working days.

9.7. In all cases, the Seller is released from responsibility for the violation of the terms of delivery of the goods, if the goods are not delivered to the Buyer or are delivered late due to the Buyer’s fault or due to circumstances beyond the Buyer’s control.

9.8. The delivery fee is indicated when the order is created until it is confirmed.

10. Product quality guarantee and expiration date

10.1. The Seller declares that the Goods meet the usual quality requirements for these goods. Each characteristics and sizes of the product sold by the online store www.loconinjo.lt  are generally indicated in the product description attached to each product.

10.2. The seller is not responsible for the fact that the color, shape or other parameters of the goods in the children’s clothing online store www.loconinjo.lt may not correspond to the actual size, shape and color of the goods due to the characteristics of the display used by the Buyer..

10.3. In the event that the Seller does not provide a quality guarantee for certain types of goods, the guarantee provided by the relevant legal acts shall apply.

10.4. The Seller is not responsible for the deterioration of the quality of the goods, if the Buyer or persons to whom the Buyer transferred the goods used them for purposes other than those for which such goods are usually used, did not comply with the requirements specified in the instructions, violated the rules of transportation, storage, use and / or storage of the Goods, as well also, if the packaging of the Goods or other external defects are visible, not discussed in writing during the handover of the Goods, or the deterioration of the quality of the Goods is caused by the actions of the Buyer or other persons to whom the Buyer has transferred the Goods.

11. Return and exchange of goods

11.1. Defects in the sold goods are eliminated, low-quality goods are replaced, returned in accordance with the 2001 order of the Minister of Economy. June 29 by order no. 217 “Regarding the approval of the rules for the return and exchange of items” approved by the rules for the return and exchange of items.

11.2. The Buyer can exercise the right provided for in the clause of the Rules within 14 (fourteen) working days from the day of delivery of the goods to him, informing the Seller about it 4.2. The procedure provided for in the clause of the rules.

11.3. When returning goods to the buyer, it is necessary to comply with these conditions:
11.3.1. the returned item must be in its original, neat packaging;
11.3.2. the product must be undamaged by the Buyer;
11.3.3. the product must not have lost its commercial appearance (labels intact, protective film not torn off, etc.). This clause does not apply in case of return of defective product;
11.3.4. the returned item must be in the same package as the one received by the Buyer;
11.3.5. when returning the product, it is necessary to present the document of its purchase (if it was issued).

11.4. The Seller has the right not to accept the goods returned by the Buyer if the Buyer does not follow the procedure for returning the goods established in this article.

11.5. The Buyer can deliver the returned goods himself after prior agreement with www.loconinjo.lt online store staff, section „Contacts“ by the specified means of communication, or sent using the courier services of your choice or the Seller’s. In case the product is returned, based on 4.2. The Buyer bears the costs of returning the goods. When the received wrong product and/or low-quality product is returned, the Seller undertakes to take such products and replace them with similar suitable products. In the event that the Seller does not have similar goods, he returns the money paid for the item(s) to the Buyer.

11.6. The return and exchange of goods is carried out in accordance with the 2001 regulation of the Minister of Economy. June 29 by order no. 217 approved “Rules for return and exchange of items” and the Minister of Economy in 2001. August 17 by order no. 258 of the approved “Rules for the sale of goods and provision of services when contracts are concluded using means of communication”.

11.7. The rules for exchange and return of items (Valstybės Žinios, 2001.07.07, No.: 58, Publ. No.: 2105) determine the goods for which the Customer does not have the right to make demands for their return or replacement:
11.7.1. perfumery, cosmetics and toilet preparations;
11.7.2. baby clothes;
11.7.3. men’s, boys’, women’s or girls’ undershirts, nightgowns, pajamas and similar articles;
11.7.4. bras, corsets and similar goods;

11.7.5. printed books, reproductions and other products of the printing industry;
11.7.6. tights, stockings, socks and other similar goods;
11.7.7. toys, games, except sports and fishing equipment.

12. Responsibility

12.1. The buyer is fully responsible for the correctness of the data provided in the registration form. If the Buyer does not provide accurate data in the registration form, the Seller is not responsible for the resulting consequences.

12.2. The buyer is responsible for the actions taken while using this online store.

12.3. The buyer is responsible for the transfer of his login data to third parties. If the services provided by the online store www.loconinjo.lt are used by a third person who has connected to the www.loconinjo.lt online store using the Buyer’s login data, the Seller considers this person to be the Buyer.

12.4. The Seller is released from any responsibility in cases where the losses arise because the Buyer, regardless of the Seller’s recommendations and his obligations, did not familiarize himself with these Rules, although he was given such an opportunity.

12.5. If in the Seller’s online store www.loconinjo.lt there are links to the websites of other companies, institutions, organizations or individuals, the Seller is not responsible for the information or activities carried out there, does not supervise or control those websites and does not represent those companies and individuals.

12.6. In the event of damage, the guilty party compensates the other party for direct losses.

13. Marketing tools used by the seller

13.1. The seller can, at his discretion, initiate various promotions in the online store www.loconinjo.lt.

13.2. The seller has the right unilaterally, without separate notice, to change the conditions of the shares, as well as to cancel them.

14. Exchange of information

14.1. The Seller sends all notifications to the e-mail address provided in the Buyer’s registration form.

14.2. The Buyer sends all messages and questions to the Seller www.loconinjo.lt in the online store section „Contacts“ specified means of communication.

15. Final Provisions

15.1. It is strictly forbidden to copy or otherwise distribute the information on www.loconinjo.lt without the written permission of the store.

15.2. These rules are drawn up in accordance with the legal acts of the Republic of Lithuania.

15.3. Relations arising on the basis of these rules are governed by the law of the Republic of Lithuania.

15.4. All disagreements arising from the implementation of these rules shall be resolved through negotiations. If an agreement cannot be reached, disputes are resolved according to the procedure established by the laws of the Republic of Lithuania.
